What Is a Guardianship?
A guardianship is a court proceeding over someone who is incapacitated and lacks sufficient understanding to make or communicate informed decisions for themselves.
The petition for guardianship, filed at the county probate court by someone interested in the welfare of that person, must state a specific reason for the person’s incapacity, such as mental illness, mental deficiency, physical illness or disability, chronic intoxication or chronic drug use.
Once appointed, a guardian can direct that person's decisions regarding health care, living arrangements, handling income and property, and arranging for appropriate supportive services. Sometimes, the incapacitated person will also need a conservator appointed to manage his or her money and assets. An emergency guardian can also be appointed if the need is dire.
